Spring Festival departure dilemma: On this Spring Festival journey full of joy and expectation, we received an urgent request for help from a client working in the Philippines. He was full of longing for home and was about to embark on the journey home to spend warm time with his family, but encountered unprecedented legal difficulties when going through the departure procedures. When going through the departure procedures, a sudden "accident" - an unknown criminal case and a prohibition order (as shown below) was like a bolt from the blue, instantly shattering this expectation. Faced with language barriers, differences in legal systems, and unfamiliarity with the local environment, how to break through the siege and regain the wings of freedom?

Interpretation of the Feilong Lawyers Team:
The prohibition order pointed out that the client was suspected of committing fraud under Republic Act (RA) 8799, also known as the Securities Law, and RA 10175, the Cybercrime Prevention Act. Specifically, the defendants were charged with violating Sections 8.1, 26.1, and 26.3 of RA 8799 of the Securities Act, which target fraudulent activities in securities transactions. These include using any device or means to defraud or deceive another person in securities transactions, making false statements or omitting material facts in the purchase or sale of securities, and manipulative acts in securities transactions. In addition, the defendants were also charged with specific violations of Section 6 of RA 10175, the Cybercrime Prevention Act, which states that any crime punishable by existing law, if committed using information and communications technology (ICT), shall be subject to the Cybercrime Prevention Act. This means that fraudulent or deceptive acts related to the Securities Act are considered aggravated if committed through ICT - such as online platforms, emails, or other electronic means. Therefore, the prohibition order here mainly accuses the client of suspected fraudulent activities related to securities using digital means or technology and is prohibited from leaving the country.

Response of the Feilong Law Team:
The steps our lawyer team takes when encountering such a situation are, first, to quickly analyze whether the case is a simple immigration case or a case involving the court. Second, we identify the type and authenticity of the departure order. If it is a court case, we retrieve the case files to find out the facts of the case and verify whether there are procedural errors or misjudgments. If it is a simple immigration case, we formulate a handling strategy based on the internal records of the Immigration Bureau. Third, we communicate directly with the Philippine judicial authorities and the Immigration Bureau to end the case or strive to revoke the improper judgment in accordance with the court and Immigration Bureau procedures. Fourth, after the case is handled, we apply to the court to revoke the departure order and submit it to the Immigration Bureau, the Ministry of Foreign Affairs, the National Bureau of Investigation, the Ninoy Aquino International Airport and other relevant departments to strive for the freedom of entry and exit for our clients as soon as possible.
